preamble

Presumptions in the original survey

Mandatory rebuttable domestic-violence presumption against legal decision-making and parenting time. The parent must rebut it by clear and convincing evidence for sole/joint decision-making or unsupervised time, and by a preponderance for supervised time (§ 25-403.03(C)–(G), (M)).

Scope, exceptions and safeguards

Child's voice / age rule

none

Child's voice qualification

The wishes of a child of suitable age and maturity remain a factor under § 25-403(A)(4). Under § 25-403.03(F)(3), however, a preference to reinstate, maintain or increase contact with the parent who committed domestic violence is irrelevant to the domestic-violence presumption; this is not a general exclusion of the child’s wishes.

Effect of silence

No automatic authorization stated: after 30 days, relief to prevent relocation requires good cause; existing court orders remain in force unless otherwise ordered (§ 25-408(C), (E)).

What the court weighs

The court decides according to the child's best interests, considering all relevant factors, including the 25-403 factors and these: the good faith of the move or the objection. The advantage of the move in improving the general quality of life for the custodial parent or child. The likelihood of compliance with parenting-time orders. Realistic parenting time for each parent. The effect on the child's emotional, physical or developmental needs. Motives and any financial advantage. And the effect on stability (25-408(I)). To the extent practicable the court must make appropriate arrangements for a meaningful relationship with both parents (25-408(G)).

Who carries the burden

On the parent seeking to relocate, who bears the burden of proving what is in the child's best interests (25-408(G)). It does not shift. A parenting-plan or written-agreement clause on relocation carries a rebuttable presumption that it is in the child's best interests, so the party departing from it must show it no longer is (25-408(H)).

Notice and safety exceptions

Yes, where both parents are entitled by agreement or order to joint legal decision-making or to parenting time, and both live in Arizona. At least 45 days' advance written notice to the other parent, by certified mail with return receipt requested or as the Arizona family court rules provide (25-408(A)-(B)). This covers a parent with sole legal decision-making whenever the other parent has parenting time (see 25-408(F)(1)). The court must sanction a parent who fails to comply without good cause (25-408(B)).

Which moves trigger the rule

Relocating the child outside Arizona, or more than 100 miles within Arizona (25-408(A)). The notice section does not apply where relocation was provided for by a court order or written agreement dated within one year of the move (25-408(D)).

Objections and the effect of silence

The nonmoving parent may petition to prevent relocation within 30 days after notice; after that, relief requires good cause (§ 25-408(C)). Subsection (E) requires continued compliance with existing orders unless the court otherwise orders and does not state that silence authorizes a move. Pending a petition or application to prevent relocation, subsection (F)(1) permits a parent with sole legal decision-making, or joint legal decision-making and the child’s primary residence, to relocate temporarily when health, safety, employment or eviction circumstances of that parent or spouse require relocation less than 45 days after written notice. Under (F)(2), a parent with joint legal decision-making and substantially equal parenting time who meets those same necessity and timing conditions may relocate temporarily only if both parents execute a written agreement.

The modification threshold

A proposed move alone does not establish a material change when the residential parent would remain in Arizona if relocation were denied (Owen ¶¶ 15–16; Backstrand fn. 2). In Backstrand, the actual move to another state changed the child’s home, school, community and implementation of the existing order, supporting a material change (¶¶ 15–17). These holdings do not make every actual move automatically material.

Other qualifications

The statute creates a rebuttable presumption in favor of any relocation clause the parents put in a parenting plan or written agreement (25-408(H)). The notice duty also switches off when either parent lives outside Arizona.
