In Cuevas Rodríguez v. Miranda Beníquez, the Supreme Court held that imputing economic capacity as a procedural sanction for failure to comply with discovery was invalid in this support-review proceeding. It reversed the appellate resolution and trial order and returned the case for updated financial information, discovery proceedings, and a support-review hearing. The Spanish opinion distinguishes voluntary acceptance of economic capacity from its use as a sanction.
