Nebraska adds custody consideration concerning equal parental access
LB 965 adds a specified evidence consideration to the nonexclusive best-interests factors.
Published November 3, 2026 · Reviewed by David Martino
LB 965 adds to the best-interests considerations for custody and parenting arrangements credible evidence showing increased intellectual and social growth in children who have equal access to both parents. The statute continues to require consideration of the other listed factors, including credible evidence of family or household abuse, and the list remains nonexclusive. The amendment does not itself direct equal parenting time in every case.
